General terms and conditions of contracting and use of LockerHouse lockers

OBJECT

These general conditions regulate the contracting of LockerHouse lockers through the website Www.lockerhouse.es (the Website) as well as their use. Likewise, these conditions regulate the contractual relationship between LockerHouse (owner of the lockers) and the User who contracts the lockers service.

THE SERVICE

LockerHouse offers its Users the possibility of renting any of its lockers for periods of hours and calendar days (within the schedules offered by LockerHouse).

Users may deposit their luggage and belongings at the LockerHouse facilities, within the reserved locker(s), exclusively during the contracted reservation time.

Once the contracting process is completed, Users will receive a reservation confirmation code, which will allow them to know the assigned locker number, the duration of the contracted reservation, as well as the access code or key to the locker, in the terms established. It is indicated in the section relating to access and reservation.

What type of lockers does LockerHouse offer?

LockerHouse offers three types of lockers:

Small lockers, whose measurements are 37 cm (height) x 49 cm (width) x 58 cm (depth). These lockers fit approximately 1 carry-on suitcase and 1 backpack.

Medium lockers, whose measurements are 47 cm (height) x 49 (width) x 58 cm (depth). These lockers fit approximately one large suitcase and 1 backpack or up to 3 carry-on suitcases and 2 backpacks.

Large lockers, whose measurements are 85 cm (height) x 49 cm (width) x 58 cm (depth). These lockers fit, approximately, (a) 4 carry-on suitcases (55x40x20 cm) or; (b) a large suitcase (80x55x30 cm).

What can a User enter in their password?

With the limits established in this document (see Section Limits on the use of lockers), a User can introduce the packages they want, within the specified measurements, so as not to overload the lockers.

How can a User know if there are free lockers?

Through the Website www.lockerhouse.es, the User will be able to find out the availability of lockers for the days desired by each User.

How long can you rent the same storage room?

The User may contract the lockers rental service for a minimum period of 1 hour.

When will the User be able to access the locker or lockers they have rented?

The lockers rental service will be accessible to the User on the selected date and time.

After the contracted reservation period has elapsed, LockerHouse will be authorized to open the locker and remove the packages. Under no circumstances will LockerHouse open any belongings or access their contents.

It is the User's responsibility to deposit their belongings properly packed and not leave belongings loose.

The removed belongings will be kept on the premises for a period of 48 hours, during which they may be claimed by the User. Once this period has elapsed, the belongings will be presumed abandoned for all purposes, with LockerHouse not assuming any responsibility for them and having the freedom to dispose of them, without any right of the client to claim against LockerHouse.

Once the packages have been inserted by the User, can they only access the locker again to remove them?

No, the LockerHouse lockers service is a lockers rental service. The User may access the rented locker as many times as they wish or need during the rental period of the locker(s). Therefore, if the User has forgotten something or needs to access their locker throughout the day, they will be able to do so without problems during the period they have reserved with the access code generated and as such notified when making the reservation.

What is the price that the User must pay per type of locker/day?

The price per consignment will be the one indicated on the Website at the time of contracting, and the User may benefit from the offers in force at all times.

The prices shown on the Website include VAT and refer to the rental of a storage room (depending on its size) per hour or calendar day.

How are the slogans used?

The lockers offered through LockerHouse are fully automatic. The User may make the reservation through our Website www.lockerhouse.es, indicating, in addition to their personal data, the number of lockers they wish to rent, their size and the reservation period. Once the contract is completed, the User will receive confirmation of the contract made, the number of the reserved locker(s) and their security code to access their locker(s).

Therefore, the User will access their locker through the security code provided by LockerHouse when making their reservation.

What can the User do if they have any type of incident in the use of the password?

In the event of a breakdown, blockage or any other type of incident in the use of the locker, the User will have the LockerHouse assistance service at their disposal, which they can use via info@LockerHouse.com.

Can the User modify their reservation or withdraw from it?

Yes, as long as said modification or withdrawal is made 24 hours in advance of the date on which the service I have booked begins.

To cancel a confirmed reservation, the User must contact LockerHouse by written communication to the following address info@LockerHouse.com.

The refund, if applicable, will be made within a maximum period of 20 days from the moment of cancellation, provided that the User has made the cancellation 24 hours before the scheduled start date. The refund will be made using the same payment method used by the customer.

Failure by any of the parties to comply with their obligations arising from these General Conditions will entitle the non-breaching party to terminate the reservation by simple written communication to the non-breaching party. The consequences of early termination of the reservation due to non-compliance by one of the parties will be the following:

In the event of non-compliance by a User, the reservation will be terminated, their belongings may be removed if the User does not do so within 2 hours of being requested and they will not be entitled to a refund of the price paid for the reservation. In the event of damage to the establishment, facilities or property of other users, the User will be liable for the damages caused.

In the event of non-compliance by the Company, it undertakes to return to the User the amount paid online for the reservation.

ACCESS AND RESERVATION

LockerHouse will use its best efforts to offer the Website in optimal condition for use 24 hours a day and to ensure, as far as reasonably possible, the security of the Website.

Notwithstanding the foregoing, LockerHouse is not responsible, in any case, for the lack of operation, temporary interruption of the Website or loss of its content attributable to third parties or for any unforeseeable event, beyond the control of LockerHouse, fortuitous event or force majeure. .

LockerHouse reserves the right to promptly interrupt access to the Website if necessary to carry out maintenance work for as long as necessary, putting its best efforts so that the interruption has the minimum duration and the least impact on the Users. .

In order to hire LockerHouse lockers, it is essential that the following requirements be met:

Have reached or been older than 16 years.

Complete truthfully and accurately the fields indicated in the form included in the RESERVATIONS Section of the Website (in particular, the following: name and surname, telephone number, email, reservation date, hours or days of rental, number of lockers you want to rent (indicating the size), data necessary to complete the payment, depending on the payment method used).

Accept these general conditions of contracting the service and use of the lockers.

Accept the privacy policy of LockerHouse, as the entity that owns the lockers.

Once the contracting process is completed, the User will receive confirmation by email. In said confirmation, the User will be informed of the number or numbers of assigned lockers, the day(s) reserved, as well as the access code(s) to the locker(s).

LockerHouse reserves the right to limit, relocate, cancel the reservation in case of possible mechanical, electrical and/or maintenance breakdowns in general, without the User having the right to claim any compensation in such cases.

If the incident is not resolved within this period, LockerHouse will assume the cost of shipping the belongings to the address indicated by the User as long as the User has had to leave without their belongings due to the breakdown. The User will not have the right to claim any other damages.

Basic information on Data Protection

Purpose- Management of the reservation formalized by the User.

Sending commercial communications by email (LockerHouse offers).

Legitimation- Execution of a contract through the formalization of the reservation.

Express consent in the case of commercial communications by email.

Recipients - The data will not be communicated to third parties, except legal obligation.

Rights- Rights of access, rectification, opposition, limitation and cancellation, in the terms detailed in this section.

The form referred to in the previous section, which must be completed by the User, contains the data that LockerHouse needs to formalize the rental of the lockers by the User, as well as to be able to comply with the contractual obligations that will arise for the parties of the service. that the User, if applicable, contracts.

The User guarantees that all the data regarding their identity, as well as the reservation provided, are true, accurate and complete.

The personal data provided will be used to manage the reservation and comply with the obligations derived from the parties of the left luggage service. LockerHouse is entitled to process the personal data provided in the contracting process by the User as it is necessary for the provision of the service. The User, by contracting, expressly consents to the processing of their personal data in the terms detailed here.

On the other hand, LockerHouse will use the personal data of Locker Users, particularly their email addresses, to send commercial communications via email about the services offered by LockerHouse and its promotional offers. If the User does not wish to receive commercial communications from LockerHouse via email, they must check the corresponding box during the contracting process. Conversely, if they accept receiving commercial communications via email, LockerHouse informs the User that such consent can be revoked at any time.

Additionally, Users are informed that surveillance cameras are installed in the lockers. These cameras are intended to monitor the condition of the lockers at all times, as well as the usage by Users or third parties accessing the premises, to ensure better service by LockerHouse. All lockers include appropriate notices about the video-monitored area in compliance with current data protection regulations.

The User has the right to exercise their rights of access, objection, restriction, rectification, and deletion of their data at any time by submitting a written request identifying themselves (including a copy of their DNI/NIE or passport) to the email address info@LockerHouse.com. If the User considers at any time that LockerHouse has violated the applicable data protection regulations, they have the right to file a complaint with the Data Protection Authorities, particularly with the Spanish Data Protection Agency.

LockerHouse does not conduct international data transfers or make automated decisions based on the information provided by the User.

LockerHouse will retain the User's personal data for as long as necessary to provide the service and for the period required to comply with its legal obligations. After this period, the data will be deleted. However, LockerHouse will retain the User's data as long as their consent to receive commercial communications via email has not been revoked, if such consent has been granted.

USER OBLIGATIONS AND LOCKER USAGE LIMITATIONS 

By contracting LockerHouse locker rental services, the User agrees to the following obligations, among others: 

1. Exclusive Use for Personal Belongings: 

   Use the reserved lockers solely to temporarily store personal belongings that the User needs to keep in a secure location. 

2. Reservation Requirement: 

   Do not use or place luggage in an unreserved locker without a valid reservation or confirmation that the locker is assigned through the booking code. 

3. Luggage Size Verification: 

   Verify luggage size before booking to avoid overloading the locker. Refunds or claims will not be accepted if the luggage exceeds the locker’s dimensions. 

4. Prohibition of Overloading: 

   Under no circumstances should the User overload the locker or place items outside the designated and reserved space. 

5. Proper Locker Usage: 

   Use the lockers diligently, ensuring they are properly locked before leaving the premises. 

6. Reporting Issues: 

   Immediately report any damage or irregularities regarding the lockers to LockerHouse. For example, if the reserved locker is occupied by another user’s belongings, the User must not remove those items. Failure to comply may result in penalties of up to €500. 

7. Prohibited Use for Illegal Purposes: 

   Do not store items whose possession or trade is illegal, such as stolen goods, drugs, pornographic materials, or other degrading items. 

8. Proper Packaging: 

   Ensure all belongings are appropriately packaged. 

9. Licensing Requirements: 

   Do not store items that require a license (e.g., firearms) without possessing the proper authorization. 

10. Hazardous Materials Prohibited: 

    Do not place contaminants, flammable objects, or hazardous substances in lockers. 

11. No Living Creatures: 

    Animals or any living beings must not be stored in lockers. 

12. Food Restrictions: 

    Only store packaged food that will not spill, stain the lockers, or emit odors. 

13. Confidentiality of Security Codes: 

    Do not share security codes with third parties. The User will be fully responsible for any breach of this obligation and its consequences. 

14. Third-Party Prohibitions: 

    Do not use lockers to store items meant for retrieval by third parties. LockerHouse does not authorize this usage. 

15. Timely Retrieval: 

    Retrieve items before the end of the rental period. 

16. Leaving Lockers Clean: 

    Leave lockers in the same condition as found and report any issues to LockerHouse at info@LockerHouse.com. 

17. No Photos or Videos: 

    Taking photos or videos inside LockerHouse lockers, especially of security mechanisms, is strictly prohibited. 

18. Valuable Items Prohibited: 

    Do not store valuable items such as money, jewelry, electronic devices (e.g., tablets, laptops, TVs), or necessary identification or travel documents. LockerHouse will not be liable for loss or damage to such items or any travel disruptions caused by storing such documents or tickets. 

USER NON-COMPLIANCE: CONSEQUENCES AND RESPONSIBILITY 

1. Rental Period Violation: 

   If the User fails to empty the locker by the rental end date, LockerHouse is authorized to remove stored items to make the locker available to other customers. Unclaimed items will be temporarily stored, and LockerHouse will attempt to contact the User for retrieval at the User’s expense. After 48 hours without contact, the items will be deemed abandoned. 

   - A daily fee equivalent to the locker rental cost will apply until retrieval, plus a €150 penalty per day. 

   - The User must pay shipping fees if items are sent back: €25 per item for domestic shipments and €50 per item for international shipments. 

2. Prohibited Use or Damage: 

   - LockerHouse reserves the right to remove prohibited items and may involve law enforcement. A €150 penalty applies, in addition to liability for damages caused. 

3. Damages to Lockers: 

   Users will bear full responsibility for damage caused by improper use, including liability for repairs, replacement (up to €1,000), or loss of use penalties. 

4. Payment of Penalties: 

   Penalties will be charged to the payment method used during the booking or via bank transfer upon request. 

LOCKERHOUSE OBLIGATIONS 

LockerHouse commits to: 

- Maintaining operational lockers in good condition for the User during the rental period. 

- Addressing any issues promptly to safeguard User belongings, potentially moving them to secure storage if necessary. 

LIMITATION OF LIABILITY 

LockerHouse provides locker rental services and is not responsible for the safekeeping of items. Its liability is limited to the rental period. 

- A theft insurance policy covers losses up to €250 per locker but excludes cash, jewelry, electronics, artwork, or data storage devices.

APPLICABLE LAW AND JURISDICTION 

These terms are governed by Spanish law. Disputes will be subject to Spanish jurisdiction.
